Customer Privacy Policy Disclosure
The Bank of Hampton Roads includes related financial service providers, such as insurance agencies, banks, investments and mortgage companies. Our organization continues its commitment to upholding high standards of privacy for your protection and benefit. Whether you are an existing customer or are considering a relationship with us, we want you to know how we collect, use and retain information about you and your business relationship with us.

How We Gather Customer Information:
We collect, use and retain customer information from a variety of sources for the purpose of administering our business or to provide products, services or other opportunities for our customers. We may collect the following categories of information about you:
- Information we receive from you on applications or other forms, and other oral, written or electronic communications such as your name, address, social security number, assets and income;
- Information about your transactions with us, our affiliates or others, such as your account balance and payment history;
- Information we receive from third parties, including persons, providing services in connection with your transactions and consumer reporting agencies, such as your credit history;
- Information we obtain from others to verify information provided by you, such as your employment history and credit or other relationships with third parties;
- Information collected from our Internet web site, such as information necessary to manage your online session with us.
Information We May Share Within Bank of Hampton Roads:
To the extent permitted by law, we may share information about you among the companies that make up the Bank of Hampton Roads, including:
- Our experiences and transactions with you (such as payment history, account balances and parties to transactions);
- Contact information (such as your name and address);
- Credit information received from you or others (such as information from your credit application or your employment or credit history) to evaluate your eligibility for various financial services (for example, a home equity loan at a special rate).
You may tell us not to share credit information with other Bank of Hampton Roads companies. See Your Privacy Choices below.
Sharing Customer Information Outside of the Bank of Hampton Roads:
We do not provide customer information to companies outside of the Bank of Hampton Roads, except as outlined below. You do not need to request this confidentiality – it is our standard practice. We may provide all of the information we gather to:
- Companies that perform business operations for us (such as check printing and data processing);
- Companies that perform marketing services on our behalf or financial institutions for purposes of jointly offering financial products and services;
- Others as permitted or required by law (such as to protect against fraud or in response to a subpoena).
Our policies for sharing customer information, both within and outside of Bank of Hampton Roads as described above, also apply to all of the information we have gathered about former customers of Bank of Hampton Roads and its affiliates.
How We Use Customer Information:
The customer information we gather helps us to better understand your financial needs and to provide you with superior service by offering the right services at the right time. We may use the information among Bank of Hampton Roads companies and other authorized entities for the following purposes, among others:
- To protect your accounts from unauthorized access or fraud;
- To provide you with the products and services you requested;
- To service your accounts;
- To inform you about financial products and services that may be of interest to you.
Each company within the Bank of Hampton Roads will continue to contact its consumer clients with offers of its own products and services. You will continue to receive product messages via your statement(s), as well as telephone and mail offers from Bank of Hampton Roads companies with whom you have relationships.
Because we recognize that you may wish to limit the ways in which we contact you for marketing purposes, we offer the following options. You can choose not to be contacted for marketing purposes by direct mail, telephone and e-mail. If you are comfortable with the ways in which we contact you currently, there is no need to indicate your preferences.
You also have choices about how information about you is shared among Bank of Hampton Roads. You may choose the following options:
- Unless we are otherwise permitted by law, you may choose to inform us not to share other information which you provide to us or that we receive from third parties with other Bank of Hampton Roads companies; and
- You may limit our affiliates in the Bank of Hampton Roads, such as our banking, insurance, investments and mortgage affiliates, from marketing their products or services to you based on personal information that we collect and share with them. This information includes, for example, your account balance, income, account histories, credit score and claims history. Your choice to limit such marketing offers from Bank of Hampton Roads will apply until you tell us to change your choice. If you have already made a choice to limit such marketing from Bank of Hampton Roads, you do not need to act again.

Under the Fair Credit Reporting Act, you have the right to notify us if you believe we have reported inaccurate information about your account to any Consumer Reporting Agency. Please submit your request for correction in writing and include your full name, current address, social security number, account number, telephone number and the information you believe is inaccurate. Send your notice to: Gateway Bank and Trust, Attention: Compliance Officer, 112 Corporate Drive, Elizabeth City, NC 27909. Please inform us of the reason you believe the information is incorrect and we will research and correct information appropriately.
Employee Access to Customer Information:
Our institution maintains security levels and related procedures to assist in the prevention of unauthorized access to confidential information within our organization. Secured access is delegated upon a “need to know” basis commensurate with each employee’s responsibilities. Our employees are instructed in the importance of confidentiality and are provided with written code of conduct guidelines. Appropriate disciplinary action will be taken to enforce our privacy standards.
Internet and Electronic Privacy:
With the rapid expansion of technological capability in our industry and in our institution, Bank of Hampton Roads and Trust is committed to maintaining and expanding effective systems to facilitate the convenient delivery of services, regardless of the method of delivery. We value our customers and recognize the importance of your trust and confidence in us. Information gathered via the Internet or other electronic means will be used only for appropriate purposes such as evaluation of our website’s effectiveness, designing new products or services for the benefit of our customers or estimating system capacity needed to conveniently service our customers.
We may report information about your deposit or loan accounts to credit bureaus. Late payments, missed payments or other defaults on your accounts may be reflected in your credit report.
Bank of Hampton Roads respects the wishes of those customers and prospective customers who do not want to receive telephone solicitation calls from the Bank in their homes. It is the policy of the Bank not to make a telephone solicitation call to: any person who has requested that the Bank not make such calls to the person’s residence; or any person who has put his or her telephone number on a national or state Do Not Call registry, except as otherwise permitted by law.
A “telephone solicitation call” means any call that is made for the purpose of encouraging the purchase of products and services from the Bank.
The Bank maintains a list containing the telephone numbers and names (if provided) of those persons who have told the Bank that they do not want to receive telephone solicitation calls from the Bank. Anyone may be placed on the Bank’s Do Not Call list by: sending a written request to the Bank at the address below; or calling the Bank toll free at 1-866-867-8500; or e-mailing the Bank at: customersupport@gwfh.com
The request must provide the 10-digit residential telephone number that is not to be called and the person’s name, if desired.
Once a request has been made, Bank of Hampton Roads will add the telephone number and name (if provided) to the Bank’s Do Not Call list within thirty (30) days. The Bank will maintain the telephone number and name (if provided) on the Bank’s Do Not Call list for five (5) years, unless a request is made by the person to have the number removed. If a person’s telephone number changes, another request must be submitted to have the new number added to the Bank’s Do Not Call list.
